
NBI-CCN-C-12-08990 September 26, 2012 DDROS Disposition regarding the irregularity of release of GSIS death benefit of Carmen Sabaoan Molintas in the amount of Php 51,204.4 LBP cheque #245022 dated July 27, 2004 as reimbursement of three carabaos, and accrued monthly pensions in the sum of Php55,883.9 in LBP cheque #243508 dated August 15, 2004.
Carmen Sabaoan Molintas was escorted back to the Philippines in comatose condition and died on June 8, 2004. The issuance of the first check was 49 days postmortem and the other was 68 days postmortem. The full amount of 107,088 had been received by Pedring Cagas, using the letter request of Carmen Sabaoan Molintas to mortgage the Badiwan rice paddies, thus the claim of indebtedness.
In 2007 Pedring Cagas entered a commitment to be "Caretaker" of the Estate of Carmen Sabaoan Molintas, with the fundamental role to facilitate the transfer of ownership to the "Legitimate Heirs." Five years afterward Pedring Cagas was in violation of such promise. A survey over the estate of Carmen Molintas had been carried out to partition for himself and other non-heirs. A Protest had been filed by the grandchildren at DENR and DAR over that same month.
Pity, the letter request to mortgage the Badiwan rice paddies had been paraded all over the municipality, and across Bureaus simply to takeover the estate; even after collecting a dead woman's pension money. It is important to note, that out of courtesy, an offer was made in 2011 by The Granddaughter Executive Hotelier to redeem the so thought d-e-b-t. That was turned down with an asking over six times of the stated amount in the mortgage letter request of Carmen Sabaoan Molintas.
Respondent Pedring Cagas died in 2017 in California, as yet with NO MATERIAL EVIDENCE OF MONEY TRANSFER TO CARMEN SABAOAN MOLINTAS: No document of bank transfer to the USA and NO IOU note of receipt had been presented to the National Bureau of Investigation; for the amount of Hundred Twenty Thousand Pesos mortage money.
This Ancestral land had been handed down during betrothal of Carmen Sabaoan Molintas to the Honorable Major Dennis Masaao Molintas in 1928. Notwithstanding, the Law of Succession stipulates compulsory heirs assume ownership upon death of the decedent. By so, there is no need for facilitation unless hidden intentions exist.
